State v. Stout – Following a hearing, the District Court in Washington County threw out evidence gathered in the defendant’s home and on his property pursuant to an unconstitutional search by law enforcement.
Representative Cases
State v. Seering – The Washington County District Court granted the Defendant’s request to dismiss the State’s prosecution in a case of first impression. The Iowa Supreme Court did reverse the District Court after more than a year with two justices dissenting.
State v. Seager – Alleged murder weapon suppressed in double homicide; first degree murder charges were dismissed.
State v. Petrak – The defendant was arrested for possession of a controlled substance (marijuana) after a search of his person at a University of Iowa dormitory. Following a hearing, the district court found that the defendant did not voluntarily consent to this search. The court threw out the evidence discovered by the search.
State v. Minssen – The Clinton County Attorney’s Office dismissed charges of operating while intoxicated following a District Court order finding the defendant’s constitutional rights were violated. The District Court’s findings were upheld after the Iowa Supreme Court denied the State’s application for review.
